Coverage Data API Terms and Data License

These terms ("API Terms") govern access to the Cell Surveys Coverage Data API and the statistics it returns (the "Data"), provided by Dwas Woot LLC, doing business as Cell Surveys ("we," "us," or "our"). By requesting an API key or using the API, you agree to them on behalf of yourself and the organization you represent ("you").

1. The Data

The Data are de-identified coverage statistics produced from cellular readings that users of the Cell Surveys app chose to contribute, as described in Section 4 of our Privacy Policy, and from measurements we take ourselves. The Data are aggregated and de-identified, and contain no account, device identifier, timestamp of an individual reading, route, or individual reading.

The Data combine crowd-sourced readings with our own measurements. Coverage varies by area and grows over time; signal at a place changes with network changes, weather, season, and building conditions. The Data are not an engineering survey or a guarantee of service.

2. License

While your API key is active and you comply with these API Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Data through the API and to use it for your internal business purposes, including planning, analysis, and decisions for your own projects and for your clients. You may show the Data, or maps, figures, and reports derived from it, to your clients and in your products, with the attribution "Coverage data: Cell Surveys" where the Data are displayed.

3. What You May Not Do

• Re-identify, or attempt to re-identify, any person or device from the Data, alone or combined with other information, or link the Data to a person, household, or device.
• Use the Data to track, profile, or target any individual, for advertising or otherwise, or to make decisions about an individual (such as credit, insurance, employment, or housing).
• Sell, sublicense, publish, or redistribute the Data in bulk, or offer a product whose main purpose is to provide the Data, or a substitute for the API, to others.
• Share your API key, circumvent rate limits or plan limits, or collect the Data by any means other than the API.
• Use the Data in violation of law, or in a way that suggests we endorse your product or conclusions.

If you learn that Data in your possession could identify a person, stop using that Data, tell us at [email protected], and delete it if we ask. You must bind anyone you share Data with (Section 2) to the same restrictions.

4. Plans, Beta, and Billing

Each API key has a plan that sets its monthly request allowance, the largest area per request, the history it can reach, and whether bulk export is included. During the beta, access is free and by invitation, may change or end at any time, and has no service level.

Paid plans are billed monthly in advance through Stripe, in U.S. dollars, plus applicable taxes. They renew until you cancel; a cancellation takes effect at the end of the paid month, and fees already paid are not refunded except where the law requires. We may change plan prices or limits with at least 30 days' notice before your next renewal.

5. Suspension and Termination

You may stop using the API at any time. We may suspend or end your access, with notice where practical, if you break these API Terms, if your use threatens the service or other people's privacy, or if we discontinue the API. When access ends, the license in Section 2 ends; you may keep reports you have already delivered to clients, but you must delete bulk extracts of the Data within 30 days.

6. Disclaimers and Liability

THE API AND THE DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. TO THE EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR DATA, AND OUR TOTAL LIABILITY UNDER THESE API TERMS IS LIMITED TO THE GREATER OF THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100.

You will defend and indemnify us against third-party claims arising from your breach of Section 3 or your use of the Data.

7. General

These API Terms are governed by the laws of the State of Arizona, and disputes will be resolved in the state or federal courts in Maricopa County, Arizona. We may update these API Terms; we will post changes here and, for material changes, email the address on your account at least 30 days before they apply to a paid plan. These API Terms, together with any order you place, are the whole agreement about the API. For the Cell Surveys app itself, the Terms of Service apply instead.
