Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Cell Surveys: Signal Heatmap mobile application for iPhone and Android (the "App"), our web dashboards, and the website at cellsurveys.app (together, the "Service"), operated by Dwas Woot LLC, doing business as Cell Surveys ("we," "us," or "our"). By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms incorporate our Privacy Policy by reference. Please read both carefully.

1. Description of the Service

The Cell Surveys App records cellular signal strength, WiFi networks, nearby Bluetooth devices, location, and related device data to build signal coverage heatmaps, drive history, and mileage logs, and contributes to a crowd-sourced coverage map. The Service also includes web dashboards for viewing your mileage history, trip details, and coverage maps and exporting trip data, as well as this website for information and support.

The App may collect data while running in the foreground or background (with a persistent notification where your device requires one) when you have granted the necessary permissions. You may stop collection at any time by turning off data collection in the App's Settings or stopping the survey.

What we collect, how we use and share it, and how long we keep it are described in our Privacy Policy. Use of the Service is at your own risk.

2. Eligibility and User Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using it, you represent that you meet this requirement and have the legal capacity to agree to these Terms.

You must sign in with a Google account, an Apple account, or an email address to use the App. By signing in, you agree to provide accurate information and not share your credentials. You may delete your account at any time in the App's Settings, which deletes your personal data right away, or by emailing [email protected], in which case we delete it within 30 days. Our Delete Your Account and Data page explains exactly what is deleted and kept.

3. User-Contributed Data and License Grant

By enabling data collection in the App and granting permissions (e.g., location, WiFi, Bluetooth, and motion), you voluntarily contribute measurements. You grant us a worldwide, royalty-free, non-exclusive license to use, process, aggregate, store, and share that data as described in our Privacy Policy (e.g., showing your coverage maps, trips, and mileage, and publishing the aggregated crowd-sourced coverage map). The license to your own data ends when you delete it or your account, except for aggregated maps that no longer identify you.

You retain no ownership or rights to aggregated datasets such as the crowd-sourced coverage map. You agree not to contribute data that violates any law or third-party rights.

4. Fleets (Group Data Sharing)

The App allows you to create or join a "fleet"—a private group of users who pool their survey data for shared heatmap insights. By joining a fleet:

• Your survey data is aggregated with other fleet members' data and made visible to the group as heatmap overlays;
• Individual members' raw data is not identifiable to other members;
• You may leave a fleet at any time, which stops future data sharing with that group;
• Fleet creators are responsible for sharing the fleet token and PIN only with intended members.

We are not responsible for how fleet creators distribute access credentials or for any misuse by fleet members.

5. Mileage Tracking

The Service provides mileage tracking, trip logging, and driving statistics. You may export your trip data as CSV files for your records.

Mileage figures are estimates based on GPS data and may not be perfectly accurate. We make no guarantees about the accuracy or completeness of mileage calculations. You are solely responsible for verifying your records. The Service does not provide tax, legal, or financial advice.

6. Cell Surveys Pro Subscriptions

Signal heatmaps, coverage maps and survey recording are free. Cell Surveys Pro is an optional auto-renewing subscription that adds parcel boundaries and property details, operator mode, and mileage and trip tracking with trip summaries, saved places and vehicles. One subscription covers your Cell Surveys account in the iOS app, the Android app and the web dashboard when you are signed in with the same account.

• Plans and price:Cell Surveys Pro Monthly ($4.99 USD per month) or Cell Surveys Pro Yearly ($39.99 USD per year). Prices in other countries are set by Apple or Google in local currency; the price shown in the App before you confirm a purchase is the price you pay.
• Free trial:new subscribers may be offered a 7-day free trial. Eligibility is determined by Apple or Google. Unless you cancel at least 24 hours before the trial ends, the subscription starts and you are charged the plan price.
• Billing and renewal:payment is charged to your Apple ID or Google Play account when you confirm the purchase (or when a free trial ends). The subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period, and your account is charged for the renewal within the 24 hours before the period ends.
• Cancelling:on iPhone, go to Settings › your name › Subscriptions; on Android, go to Google Play › Payments & subscriptions › Subscriptions. Cancelling stops the next renewal; Pro stays active until the end of the period you have paid for. Deleting the App or your Cell Surveys account does not cancel a subscription.
• Refunds:purchases are processed by Apple or Google, and refunds are handled by them under their policies. We cannot issue refunds for purchases made through their stores.
• Early users:accounts created before Cell Surveys Pro launched receive Pro at no charge for three months from launch. No payment method is needed, and it ends automatically.

We may change the features included in Cell Surveys Pro. If a price changes, Apple or Google will notify you and, where their rules require it, ask for your consent before you are charged the new price. Purchase records are handled as described in ourPrivacy Policy.

7. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with these Terms. You must not:

• Use automated tools (bots, scrapers, etc.) to access or overload the Service;
• Attempt to reverse-engineer, decompile, disassemble, or circumvent any part of the App/Service;
• Interfere with or disrupt the Service or others' use;
• Upload or transmit viruses, malware, or harmful code;
• Harvest or collect data about other users;
• Resell, sublicense, or commercially exploit the Service or derived data without our written permission;
• Use the Service in violation of any applicable law or regulation.

We may suspend, terminate, or restrict your access at any time if we believe you have violated these Terms or for any other reason, without notice or liability.

8. Intellectual Property

The Service, including its software, design, text, graphics, heatmaps, branding, and any aggregated data outputs, is owned by us or our licensors and protected by copyright, trademark, and other laws. You are granted a limited, non-transferable, revocable license to use the Service for your personal or internal business purposes. You may not copy, modify, distribute, sell, or create derivative works without our prior written consent.

9. Disclaimers and No Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses. Coverage heatmaps are based on survey data and may not reflect real-time or complete network performance. You use the Service at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, we (and our affiliates, officers, directors, employees, agents) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, use, goodwill, or other intangible losses arising from your use of (or inability to use) the Service, even if advised of the possibility.

Our total aggregate liability to you for any claims shall not exceed the greater of (a) the amount you paid us (if any) in the 12 months preceding the claim, or (b) US$100. Some jurisdictions do not allow limitations/exclusions of liability; in those cases, liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Dwas Woot LLC (Cell Surveys) and our affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or violation of any third-party rights or laws.

12. Changes to the Service or Terms

We may modify, suspend, or discontinue the Service (or any part) at any time without notice or liability. We may update these Terms; continued use after changes constitutes acceptance. We will post updates here and update the "Last updated" date. For material changes, we may provide additional notice (e.g., in-app) where feasible.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict of laws principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona. You agree to submit to the personal jurisdiction of those courts.

To the extent permitted by law, you waive any right to a jury trial and agree that claims must be brought individually (no class actions).

14. Additional Terms for Apple App Store Users

If you downloaded the App from the Apple App Store, these Terms are your end-user license agreement for the App, and the following also applies:

• These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the App and its content.
• Your license to use the App is limited to Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, which also allow access through Family Sharing where applicable.
• We are solely responsible for any maintenance and support of the App. Apple has no obligation to provide maintenance or support.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, or expenses attributable to a failure to conform to a warranty are our responsibility, to the extent not disclaimed in these Terms.
• We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
• If a third party claims that the App or your possession or use of it infringes that party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using the App, such as your wireless carrier's service agreement.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple has the right (and is deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

Questions, complaints, or claims about the App should be directed to us using the contact details in Section 16.

15. General Provisions

These Terms constitute the entire agreement between you and us. If any provision is held invalid, the remainder remains in effect. Our failure to enforce any right does not waive it. You may not assign these Terms without our consent; we may assign them freely. Headings are for convenience only.
